This happened before. A moderator stepped in and forced a trade because 1 team would not start.

We replaced a last pick newish commander, With a commander that hadn't commed in years.

I don't know m8, it didn't seem unfair.

So since the gather page is still being worked on this problem the best solution is just to pick the FIRST JOINER of the next gather and then repick with him and the page open with all the other 11 people from the last gather. per Teamspeak.

I picked two "new" players both of them were listed as a commander. As such one of them was probably going to command, the one that did show said he would command, not a problem, one "new" player on the field, one as comm.
However, the then field player didn't show, as such we searched for a merc, out of all the specs and people in the next gather one was available, maxamus, I didn't want to put max on the field to imbalance the teams and asked if he would command, he agreed and as such I kept my "new" player on the field.

At this point you complained this was somehow unfair, you didn't ask for us to balance the teams in anyway, as the picks for field hadn't changed, if you thought replacing a comm with a comm(who doesnt even comm) is going to break the balance im not sure what you expected in the first place.

So after just asking to re-gather and then starting because no one on my team wanted to [regather], we got our merc, you readied up and began. At which point, you clearly gave up, rushed straight to our base and got killed, you instantly gg'd and quit the server.

You broke this rule with no intention of returning and didn't find a merc. Effectively killing the gather and forcing us to re-gather because no other merc could be found. The rules state at that point people can leave without consequence.

This is not the first time you've left a gather because you've complained about the skill of a merc, I've been told of two other recent occasions, even though those times have been perfectly acceptable mercs, this is a gather - not officials, the skill is less important than just getting a player and playing so everyone can have fun.
